Definitions

For the purposes of this Agreement, the following terms shall have the meanings set out below. These definitions apply throughout all sections of the betsoft Terms and Conditions unless the context expressly requires otherwise.

• "betsoft," "we," "us," "our" — refers to betsoft Gaming Ltd., Philippines Operations, the operator of the betsoft online gaming platform accessible at betsoft.app.
• "Platform" — refers to the betsoft website, mobile web application, and all associated games, features, services, tools, and content made available to registered players.
• "Player," "you," "your" — refers to any individual who has registered a betsoft account or who accesses any part of the betsoft Platform.
• "Account" — refers to the individual player account created upon successful registration on the betsoft Platform.
• "Balance" — refers to the total PHP-denominated funds held within a player's betsoft Account, including real-money deposits and credited bonus funds where applicable.
• "Bonus Funds" — refers to promotional credits, free spins, cashback awards, or any other non-cash incentive credited to a player's Account as part of a betsoft promotion.
• "KYC" (Know Your Customer) — refers to the identity and age verification process required by betsoft before processing withdrawal requests or activating certain account features.
• "PAGCOR" — refers to the Philippine Amusement and Gaming Corporation, the primary regulatory body overseeing gambling operations in the Philippines.
• "Wagering Requirement" — refers to the minimum total amount a player must wager using Bonus Funds before those funds or any associated winnings become eligible for withdrawal.

Eligibility & Registration

Access to the betsoft Platform is restricted to individuals who satisfy all of the following eligibility criteria at the time of registration and on an ongoing basis throughout the duration of their use of the Platform.

To be eligible to use the betsoft Platform, you must:

• Be at least 21 years of age;
• Be a natural person (corporate accounts are not permitted);
• Not be accessing the Platform from a jurisdiction where online gambling is prohibited by applicable law;
• Not be a current employee, director, officer, contractor, or agent of betsoft or any of its affiliated entities, nor an immediate family member of any such person;
• Not be subject to self-exclusion on the betsoft Platform or under any PAGCOR-administered exclusion program;
• Have the legal capacity to enter into a binding agreement under Philippine law.

During registration, you agree to provide accurate, complete, and truthful information including your full legal name, date of birth, residential address, and a valid email address. Providing false or misleading information during registration constitutes a material breach of this Agreement and may result in immediate account suspension and forfeiture of all funds.

Each player is permitted to hold only one (1) betsoft Account. betsoft employs automated and manual detection systems to identify duplicate accounts. Where duplicate accounts are identified, betsoft reserves the right to suspend all associated accounts, void all pending bets, and permanently forfeit all balances across those accounts without prior notice.

Account Responsibilities

You are solely responsible for maintaining the security and confidentiality of your betsoft Account credentials, including your username and password. betsoft strongly recommends enabling two-factor authentication (2FA) on your account. You agree to notify betsoft immediately upon becoming aware of any unauthorized access to or use of your Account.

betsoft shall not be liable for any loss or damage arising from your failure to maintain the confidentiality of your Account credentials. Any action taken through your Account — whether by you or by a third party who has accessed your Account using your credentials — shall be deemed to have been authorized by you, unless you have previously notified betsoft of unauthorized access in writing.

You must not share your Account with any other person, permit any third party to use your Account, or transfer your Account to any other individual. Accounts are strictly non-transferable. betsoft reserves the right to refuse account access if we have reasonable grounds to believe that the person attempting to access the Account is not the registered account holder.

• Keep your login credentials confidential at all times;
• Log out of your Account after each session, particularly when using shared or public devices;
• Ensure your registered contact details (email address, mobile number) remain current and accurate;
• Update your account information promptly if any registered details change;
• Comply with any additional security measures betsoft may implement from time to time.

Deposits & Withdrawals

All financial transactions on the betsoft Platform are denominated in Philippine Peso (PHP). betsoft does not charge deposit fees, though your payment provider may apply their own transaction charges, which are your responsibility.

Accepted Deposit Methods: GCash, PayMaya, BPI, BDO, Metrobank, RCBC, and UnionBank. betsoft reserves the right to add, modify, or remove accepted payment methods at any time without prior notice. Minimum and maximum deposit limits per transaction apply and are displayed within the betsoft cashier at the time of deposit.

Withdrawal Processing: Withdrawal requests are subject to the following conditions:

• Your KYC verification must be fully completed and approved before any withdrawal is processed;
• Withdrawals will be processed to the same payment method used for your most recent deposit, unless betsoft expressly approves an alternative at its sole discretion;
• Any active Bonus Funds and associated wagering requirements must be satisfied before real-money funds are eligible for withdrawal;
• betsoft reserves the right to request additional documentation to verify the source of funds before processing any withdrawal;
• Withdrawal processing times vary by payment method; GCash and PayMaya withdrawals are typically processed within 24 hours on business days;
• betsoft reserves the right to set maximum withdrawal limits per transaction, per day, and per calendar month.

Bonuses & Promotions

betsoft offers various promotions, bonuses, free spins, cashback offers, and other incentives to both new and existing players. All bonuses and promotional offers are subject to specific terms and conditions that are published alongside each individual promotion. By claiming any bonus or promotional offer, you agree to the specific terms of that promotion in addition to this Agreement.

General bonus terms that apply across all betsoft promotions unless otherwise specified include:

• Each promotion is available to eligible players only and may be limited to one claim per player, per household, per IP address, and per payment method;
• Bonus Funds are separate from real-money funds in your Account; real-money funds are used first unless otherwise specified;
• Wagering requirements must be completed within the time period specified for each promotion; failure to do so will result in the forfeiture of Bonus Funds and any associated winnings;
• betsoft reserves the right to modify, suspend, or withdraw any promotion at any time without prior notice;
• betsoft reserves the right to withhold or reclaim bonus payments where it reasonably determines that a player has engaged in bonus abuse, including but not limited to: using multiple accounts, exploiting technical errors, coordinated wagering with other players, or placing low-risk hedged bets;
• Winnings generated from Bonus Funds may be subject to maximum cashout limits as specified in the applicable promotion terms.

Game Rules & Fair Play

Each game category available on the betsoft Platform — including slots, live dealer games, bingo, fishing games, color prediction, and sports betting — is governed by its own individual game rules, which are accessible from within each game. In the event of any conflict between individual game rules and this Agreement, the individual game rules govern with respect to gameplay, and this Agreement governs with respect to account management, financial transactions, and conduct.

All betsoft casino games utilize certified random number generator (RNG) technology. RTP (Return to Player) percentages for all slot games are published transparently within the betsoft Platform. Live dealer games are conducted by trained croupiers in real-time and are not pre-recorded. betsoft does not manipulate game outcomes.

In the event of a technical malfunction, disconnection, or system error during gameplay, betsoft will make reasonable efforts to reconstruct game state data and resolve the issue fairly. Where game reconstruction is not possible, bets placed during a confirmed technical error may be voided and stakes returned to the player's Account. betsoft's decision regarding technical malfunction outcomes is final.

• Bets placed and confirmed prior to any technical issue are generally considered valid and will be settled according to the recorded outcome;
• betsoft is not responsible for losses arising from a player's own internet connectivity issues, device malfunctions, or browser incompatibilities;
• Game result histories are logged and available within your account for review;
• Disputes regarding game outcomes must be submitted to betsoft support within thirty (30) days of the relevant game round.

Prohibited Conduct

The following conduct is strictly prohibited on the betsoft Platform. Engaging in any prohibited conduct constitutes a material breach of this Agreement and may result in immediate account suspension, permanent account closure, and forfeiture of all funds.

• Registering more than one (1) betsoft Account;
• Providing false, misleading, or incomplete information during registration or KYC verification;
• Using the Platform while under 21 years of age;
• Accessing the Platform from a jurisdiction where online gambling is prohibited;
• Using software tools, bots, automated scripts, or artificial intelligence systems to gain an unfair advantage over other players or the Platform;
• Colluding with other players in any game type, including but not limited to live dealer games, poker, and sports betting;
• Engaging in any form of match-fixing, cheating, or manipulation of game outcomes;
• Using the betsoft Platform for any money laundering, fraud, or other unlawful financial activity;
• Attempting to reverse-engineer, hack, or interfere with the betsoft Platform, its servers, or its underlying software;
• Engaging in abusive, threatening, harassing, or offensive conduct toward betsoft staff or other players;
• Exploiting bugs, errors, or technical vulnerabilities in the Platform without immediately reporting them to betsoft support.

Intellectual Property

All content on the betsoft Platform — including but not limited to software, source code, game assets, graphics, logos, trademarks, trade names, text, audio, video, and user interface design — is the exclusive property of betsoft Gaming Ltd. or its licensors, and is protected by applicable Philippine and international intellectual property laws.

betsoft grants you a limited, non-exclusive, non-transferable, revocable license to access and use the betsoft Platform solely for your personal, non-commercial entertainment purposes, subject to your compliance with this Agreement. This license does not include the right to:

• Copy, reproduce, distribute, or publicly display any betsoft content without express written permission;
• Modify, adapt, translate, or create derivative works based on any betsoft content;
• Use any betsoft trademark, logo, or trade name in any manner that could cause confusion or imply endorsement;
• Scrape, data-mine, or systematically extract content from the betsoft Platform.

Any unauthorized use of betsoft intellectual property will result in immediate termination of your license to use the Platform and may expose you to civil and criminal liability.

Limitation of Liability

To the fullest extent permitted by applicable Philippine law, betsoft's total aggregate liability to you arising from or in connection with your use of the betsoft Platform — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total amount of real-money deposits made by you to your betsoft Account in the thirty (30) days immediately preceding the event giving rise to the claim.

betsoft shall not be liable for:

• Any indirect, consequential, special, incidental, or punitive damages, including loss of profits, loss of opportunity, or loss of data;
• Any failure or delay in Platform performance caused by circumstances beyond betsoft's reasonable control, including force majeure events, government actions, natural disasters, internet outages, or third-party service failures;
• Any losses arising from your use of the Platform in violation of this Agreement or applicable law;
• Any losses arising from unauthorized access to your Account where such access resulted from your failure to maintain the security of your credentials;
• The accuracy, completeness, or availability of third-party payment services or banking partners.

Privacy & Data Protection

betsoft collects, processes, stores, and uses your personal data in accordance with its Privacy Policy, which is incorporated into this Agreement by reference. By using the betsoft Platform, you consent to the collection and use of your personal data as described in the Privacy Policy.

betsoft collects personal data including your name, date of birth, contact information, payment details, device information, and gameplay history for purposes including account management, KYC compliance, fraud prevention, regulatory reporting, and service improvement. betsoft does not sell your personal data to third parties for marketing purposes.

betsoft retains your personal data for as long as your Account is active and for a period thereafter as required by applicable Philippine law, including anti-money laundering record-keeping requirements. You may request access to, correction of, or deletion of your personal data by contacting betsoft support, subject to legal retention obligations.

Responsible Gaming

betsoft is committed to promoting responsible gaming among all Filipino players. Gambling should be an enjoyable form of entertainment — never a way to resolve financial difficulties, recover past losses, or generate income. betsoft provides a comprehensive suite of responsible gaming tools that all registered players can access at any time from their Account settings.

Available responsible gaming tools on betsoft include:

• Deposit Limits — Set daily, weekly, or monthly limits on the amount you can deposit;
• Loss Limits — Set limits on the amount you are willing to lose within a defined time period;
• Session Time Reminders — Receive notifications when you have been playing for a specified duration;
• Cooling-Off Periods — Temporarily suspend your account for a defined period (24 hours, 7 days, 30 days);
• Self-Exclusion — Permanently or indefinitely exclude yourself from the betsoft Platform. Self-exclusion requests are processed within 24 hours and are irrevocable for the duration of the exclusion period chosen.

betsoft reserves the right to impose responsible gaming restrictions on any account where we identify patterns of behavior consistent with problem gambling, regardless of whether the player has self-requested such measures. This includes proactively reducing deposit limits, enforcing cooling-off periods, or triggering mandatory KYC review.

Amendments to These Terms

betsoft reserves the right to amend, update, or replace these Terms and Conditions at any time. When material changes are made, betsoft will provide notice via email to your registered email address and/or by displaying a prominent notice on the betsoft Platform for a period of not less than seven (7) days prior to the amended terms taking effect.

Your continued use of the betsoft Platform following the effective date of any amended Terms constitutes your acceptance of the amended Terms in full. If you do not agree with any amended Terms, you must immediately cease using the Platform and contact betsoft support to initiate account closure.

It is your responsibility to review these Terms periodically to stay informed of any updates. The "Last Updated" date at the top of this page indicates when the most recent revision was made. Archived versions of previous Terms are available from betsoft support upon written request.

Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute, controversy, or claim arising out of or in connection with this Agreement, including its validity, interpretation, breach, or termination, shall first be submitted to betsoft's internal dispute resolution process.

To initiate a dispute, you must submit a written complaint to betsoft support at the contact details provided in Section 14, clearly describing the nature of the dispute and the resolution you are seeking. betsoft will acknowledge your complaint within two (2) business days and provide a substantive response within fourteen (14) business days.

If your dispute is not resolved to your satisfaction through betsoft's internal process, you may escalate the matter to PAGCOR or pursue resolution through the appropriate courts of competent jurisdiction in the Philippines. You agree that the courts of the Philippines shall have exclusive jurisdiction over any dispute arising from this Agreement that cannot be resolved through internal or regulatory channels.

Nothing in this section limits betsoft's right to seek injunctive or other equitable relief from any court of competent jurisdiction in cases of suspected fraud, breach of intellectual property rights, or other conduct requiring immediate legal remedy.
